Worst luck of the draw 4790k

I got 4.4GHz on air with no voltage increase and at around max 73 C but even going to 4.43Ghz on water and the chip topped out on thermals So there is hard wall on DC. On Ivy Bridge, I never got above 4.2 on water so it's not you or your mobo, just the chip.
So I presume if I call intel about this worst luck of the draw chip of mine they will just disregard it right?
Yes. The chip works. At least at stock speed and voltages, so it's not faulty. That's just the way it is. My last chip (FX-8320) also was very bad.
I follow a 10% guideline. If the variation is under 10%, I skip upgrading or overclocking that chip. You're unlikely to feel any change between 4.2GHz and 4.4GHz o/c. Choose the lower one, as it fits well with a quiet air cooler and standard voltages. A method to boost "perceived speed" involves disabling Intel Speed Step, C States, and CPU spread spectrum in the BIOS. This often leads to quicker startup times, faster web loading, and quicker system booting (though I personally notice it). For around 10-15 watts of extra power, it performs similarly to overclocking.
My 3570k only reaches 4.1Ghz. Based on what I see online, I thought I could achieve 4.6Ghz. We have two identical AMD phenom II processors, both fully overclocked to their limits. One is running at 4.0Ghz, which is quite solid for a Phenom II, the other is at 3.4Ghz and won't go any higher. In this CPU competition, there are winners and losers, and you can't ask for your money back.
