I see your point, but it doesn’t clarify anything. It might be better to return the item honestly. If you mention it’s the BIOS, they probably won’t care much. In the worst case, they might just replace the BIOS chip without much thought. Also, I feel like you misinterpreted the situation. This means the warranty is definitely void if the issue stems from your own actions. Updating the BIOS doesn’t affect the PCI lock at all. I’m not sure it would be legal if they claim you damaged something unrelated that didn’t harm the board. Good luck!
