Everyone criticizes fake Windows, but why does my system let me keep using the OS without warning it's not real? If it detects the lack of a license, shouldn't it clearly say so instead of just skipping the upgrade? Thanks for pointing this out, Dan.

With a non-original Windows 8 version, it's possible to obtain a real license since you weren't able to upgrade to 8.1.

You can upgrade to a non-genuine version of Win10. The license remains unchanged, but you can proceed with the installation. Obtain the genuine key afterward.
