They aren't sure whether you're using an OC if you don't mention it. Steve from GamersNexus showed this by checking Intel CPUs and XMP settings in a recent video. If you return your RAM but don't disclose you overclocked, they can't confirm it.
They simply wouldn't have a way to confirm it, so your main concern is whether you're okay lying about it. No. Even if you could damage the DIMM with excessive VDIMM, they'd still be unable to verify you actually increased their speed.
@BrendanR, verify the frequency was adjusted properly. Just setting the frequency without enabling XMP (INTEL) or DOCP (AMD) means timings stay at their default settings, and you're missing out on performance gains. Enabling XMP or DOCP will automatically set the frequency to its rated value.
