Earlier I could get a copy of El Capitan on my Mac, but now Sierra is available in the App Store so it seems removed. Can I still download a version of El Capitan without upgrading to Sierra because of performance issues?
Once Apple releases the next update, they completely remove the previous version. Your best option is to search through less mainstream websites in hopes of locating a clean DMG (they’re actually quite accessible). They also seem to have disabled the .app file after installing Sierra on your Mac, preventing you from re-downloading it and stopping Hackintosh attempts.
It seems Apple has altered its policy regarding offering installation files for older OSX versions on the App Store. I also remember being able to download Yosemite, Mavericks, and Mountain Lion installation DMG files, but they’re no longer available.
It seems there might be some confusion about copyright and sharing content. If you have the right to use the material, then downloading it legally is fine.

Every OS X release starting with Lion automatically removed the installer post-installation, though you could always save a backup before starting. If you obtained it from the AppStore, it stays in your purchased list, which I’ve used to fetch the latest full installers for Yosemite and El Capitan to ensure a USB drive is current for emergencies or recovery.
You could simply access the purchased section and save it directly...
