It's against the law no matter who owns the game. Just checking the top result about recording Nintendo ROMs on YouTube.

It varies by location, and having actual physical copies usually qualifies as fair use. The main point is you may need to remove your own ROMs, but with devices like the Retron 5 becoming common, it’s much simpler now.

Nintendo clearly states that it is illegal to have a rom in your possession. There is no debate on that. You could just record it, and most likely you'll be fine but you are still breaking the law. Copyright is not copyleft. Now when you say "US Copyrights don't affect other countries." That again is false. There are many treaties that the US and other countries are tied to like the WTO that share copyrights. A full list of the countries and treaties that they are bound by is found at this website. http://www.copyright.gov/circs/circ38a.pdf Again that is illegal. Read up on this link

I believe the most unlikely outcome involves the video being removed, especially if you're not generating revenue from it. From some basic YouTube searches, it seems many have tried this before.
