Well, that does sound a bit over the top. ^^ In my view, this is just damage control, though there are definitely worse options. Of course he can't address everyone or even a small fraction, but his willingness to take questions is impressive. If people truly don’t care, it should fade away—mistakes happen, and they’ll learn soon enough. Other firms have been let off the hook for worse (though that doesn’t mean complaints are unnecessary).

Yes, that's common. Generally, purchasing from Nintendo is tailored for particular purposes, rarely impacted by their retro policies. If your only interest is in Mario Kart and Zelda, it's unlikely you'll encounter their content on YouTube or other distractions.
I'm not sure about all this... Mods should be free, but if they're paid, they should pay a fee or similar to the game/engine, just like other games. As for the amount, it should depend on what they can agree upon, similar to how artists or small studios handle publishing and distribution. I think 25% might be too low; 35-40% would be better, and around 50% seems ideal. (Check any small game discounts—probably not much more than this, depending on the approach)
