For the same hardware you can use your previous product key. From what I know, you can only move up to a prior Windows version using an upgrade key.

The key is also visible on the sticker at the bottom of the laptop or on the desktop. Keys remain the same whether you install fresh or upgrade; upgrading simply means switching to a newer operating system while keeping your files intact. You can only upgrade to the same architecture—so if you have a 32-bit system, you can only upgrade to another 32-bit version. If you wanted 64-bit, you’d need a fresh installation, and vice versa. I don’t understand why someone would choose 32-bit over 64-bit.

It doesn't matter what version of Windows you use, whether it's a newer system or an older laptop. You might need to begin the installation from within Windows, even if there are issues with the UEFI setup Microsoft introduced in version 8.
