It isn't permitted by law, yet it generally allows you full freedom to handle the file. The software isn't specifically designed for the exact system it was obtained on.

There isn’t a built-in option within Mountain Lion to upgrade directly to Mavericks. You’d need to download and install the Mavericks application separately, as it’s not available in the OS itself.

MacOS probably wants to upgrade you to the newest release. That’s possible, even if it’s unusual for me.
