Usually: Yes, yes, accordingly. When transitioning from Windows 7 to Windows 8 (excluding 8.1), you may retain any files in your Documents folder.

During startup from the Windows 8 installation media, you'll encounter advanced settings. Within these, you'll find an option to format. The formatting process will delete the selected partition and erase all existing data. If you skip formatting and install Windows 8 on the same drive as Windows 7, after setup your Windows 7 account will appear in a folder named Windows.old. You might consider upgrading from Windows 7 to Windows 8 by reducing the partition size, installing Windows 8 on a fresh partition, enabling dual boot, and ensuring you back up your information before wiping the drive for a clean installation.
