Hello, I noticed your NVIDIA GTX970 has a BIOS version of 84.04.36.00.5D with a BIOS date from 2014. Is it possible to upgrade the BIOS to enhance my GTX 970?

actually, many things like this are common—especially when components stop working. For example, intel removed xeon support from skylake 100 boards that used to work with all previous boards.
now you see similar situations; some parts still function while others don’t. If you have the part, it might still be supported, but others won’t.

What is the model of your card? Look on the manufacturer's website and see if they have a newer BIOS for it.

Interestingly, I haven't located any GTX 970 produced by "Elitegroup" (ECS - Elitegroup Computer Systems, usually recognized for motherboards). Considering this, I wouldn't attempt to install a different BIOS, as it might be an OEM variant that lacks documentation. What specifically needs a new BIOS? For a standard 970, overclocking is possible using tools like MSI Afterburner.
I believe the information you shared doesn't apply to all Gigabyte 970 cards. The 3.5 memory issue seems to be a NVidia hardware problem, and it appears that fixing it is not supported for this model. The only solution mentioned is a $30 refund, which I think you might be too late to claim.
