Not a patent or trademark claim. They hold a trademark for the term "Fallout" in the gaming context because the series is known as Fallout. Any title featuring "fallout" naturally evokes the franchise. Whether Zenimax has the right to pursue games using that word would depend on court decisions, with strong arguments on both sides. It seems the developer of Fortress Fallout is merely rebranding rather than challenging the original, as a costly legal battle would be impractical.

This claim seems exaggerated. The phrase "fallout" isn't a unique term, making copyright enforcement difficult.

Fallout refers to radioactive particles released into the air after a nuclear event and settling back as dust or falling in rain. It also describes negative consequences or outcomes of a particular circumstance. The term is open for use by anyone, provided it isn’t imitating the original brand.

Just hope Bethesda reveals the upcoming Fallout and TES titles sooner rather than later. Sure, go at your own pace, but announcing them early would be great!

They’re hosting a conference at E3 this year. It would be absurd if they didn’t at least make a joke about one or both of them.
